Jonothan Moss, principal lawyer in our dispute resolution team, has successfully challenged the imposition of a contingent destruction order upon a family pet dog.
The owner of the dog pleaded guilty to allowing the dog to be dangerously out of control and the Prosecution had applied for the order in addition to sentence.
Jonothan was able to persuade the Judge that the order was neither necessary nor proportionate and the court, having heard full arguments from both sides agreed with Jonothan. This judgement was greeted with great relief by the family.
