B P Collins' dispute resolution team recently advised a client in relation to their claim against the financial services arm of a well-known luxury car manufacturer.
The client purchased the vehicle from an authorised dealership on a hire purchase agreement in June 2017, with a value of over £170,000. The vehicle repeatedly suffered major faults and returned for repairs on numerous occasions, all of which unsuccessfully resolving the faults. As a result, the client was left without the vehicle for a number of months whilst continuing to meet substantial monthly payments under the hire purchase agreement. After becoming frustrated at both the car manufacturer and finance company’s inability to satisfactorily repair or replace the car, B P Collins were instructed to pursue a claim under the Consumer Rights Act 2015.
Rajiv Malhotra of the firm’s dispute resolution team helped their client achieve an early settlement without having to issue court proceedings. The client secured the return of the entire deposit paid under the hire purchase agreement, a proportion of rental paid along with financial compensation. The swift settlement achieved meant that the client achieved a clean-break solution, whilst avoiding the substantial legal costs that can come with a protracted dispute of this kind.
